So today I got in a fender bender, front right fender is completely wrecked. The idiot who hit me backed into me without looking. I don't know what the process is for accidents, am I supposed to contact my insurance company as well as his?

I had two passengers in my car who saw everything, but I dont think they would be considered witnesses since they were my passengers.

Donno if this helps, but according to SA law, a witness is a witness, regardless of whether he's your friend or not. But their testimonies shouldn't be necessary if the plaintiff (the party that caused the damage) admits guilt.

First thing you should have done was call the cops (in most states
you're required to do this if damage is over a few hundred dollars). Then get
the name, number of HIS insurance company (hope he was
insured). If you're sure it was 100% his fault you get them
to pay. Don't even have to contact your insurance company and
you don't want to. Putting in a claim with your own company will raise your rates.
